Mr. Perez-Daple is an experienced intellectual property attorney who has handled a wide-range of matters for clients of all sizes, from large multi-national corporations to small start-up companies. Mr. Perez-Daple advises clients on issues including patents, trademarks, trade secrets, copyrights, contracts and general business matters. Mr. Perez-Daple also has experience preparing and filing patent and trademark applications and represents clients in front of the United States Patent & Trademark Office.
As a seasoned litigator, Mr. Perez-Daple uses his experience handling actual disputes to help his clients avoid them. Having seen how disputes actually play out in court provides a valuable perspective for helping clients to evaluate risk when making strategic business decisions and forming relationships with other companies.
Mr. Perez-Daple previously worked as a trial attorney for a major international law firm, where he handled all stages of complex patent litigation in federal district court, including discovery, taking and defending depositions, working with experts, claim construction hearings, motion practice, briefing, and preparing witnesses for trial.
While attending law school, Mr. Perez-Daple served as an editor on the Harvard Journal of Law and Technology (JOLT), where he was fortunate to interact with many top minds dealing with issues at the forefront of today’s rapidly evolving, high-tech society.
Prior to attending law school, Mr. Perez-Daple served as a Patent Examiner at the United States Patent & Trademark Office, where he examined patents in advanced technologies including computer networking, artificial intelligence, computer simulation, and control systems.
REPRESENTATIVE EXPERIENCE:
· Prepared and filed patent application for consumer cosmetic device on behalf of client, a small business owner.
· Wrote successful motion to stay on behalf of client, a major auto manufacturer, in the District of Maryland.
· Part of trial team that obtained verdict of patent infringement on behalf of client, an innovator of wireless communications technologies, in the District of Delaware.
· Participated in inter partes review proceedings for multiple patents related to hybrid electric vehicles on behalf of client, a major auto manufacturer.
· Developed litigation strategy that resulted in complete victory in the District of Delaware for the client, a leading computer software company that was accused of patent infringement.
· Managed docket of approximately 50 patent applications at all stages of prosecution in computer software, computer networking, electrical, and mechanical arts.
· Provided opinions of counsel regarding infringement and validity of competitors’ patents.
· Performed risk assessment and analyses in advising client whether to pursue litigation.
· Counseled client, a leading computer software company, regarding strategic impact of patent sales and acquisitions on portfolio strength.
